Waiver

This Agreement applies to all CarComfort services involving the customer’s vehicle, including EV charging, detailing, interior cleaning, exterior washing, polishing, mobile services, pickup and drop-off, transportation, and any other requested service. By using these services, the customer voluntarily entrusts their vehicle to CarComfort and its service providers for valet driving, EV charging, car washing, and detailing. The customer understands that operating a vehicle involves inherent risks and damage that may result from road debris, environmental conditions, ordinary wear, and actions by third parties. CarComfort is not responsible for these risks or damage. The customer releases CarComfort and its employees, contractors, and representatives from liability for any loss, damage, or injury to the vehicle or its contents unless it is directly caused by CarComfort’s proven negligence.

The customer agrees that CarComfort is not liable for mechanical failures, electrical problems, battery degradation, or software and electronic malfunctions. Issues resulting from pre-existing damage, aging parts, aftermarket modifications, or manufacturer defects. Damage or loss caused by weather, vandalism, construction zones, road hazards, break-ins, theft, or other third-party acts beyond CarComfort’s control. Delays caused by charging network outages, station unavailability, traffic, or force majeure events. If the customer believes damage occurred during service, they must notify CarComfort in writing within 24 hours after the vehicle is returned. Claims submitted after that period may be denied. Any liability by CarComfort is limited to the lesser of: (a) the direct repair cost for damage caused by CarComfort’s proven negligence, or (b) the total amount the customer paid for the service appointment during which the issue occurred. The customer agrees not to pursue claims, chargebacks, or legal action against CarComfort for issues caused by proven negligence.

Our services include:

  • Vehicle pick up, provide services then return vehicle back to customers
  • Transporting the vehicle to and from designated charging stations
  • Performing EV charging
  • Towing services if needed
  • Performing exterior and/or interior car wash and detailing services using approved equipment
  • Other services may be provided if agreed upon by CarComfort and customers.

Vehicle Handling & Movement

Service providers may operate the vehicle only for:

  • Pickup and drop‑off
  • Transport to charging or wash locations
  • Moving the vehicle within service facilities

No personal, commercial, or unauthorized use is allowed.

EV Charging Requirements

Service providers have agreed to:

  • Use only customer approved charging stations at the time of booking
  • Avoid charging above manufacturer recommended limits unless customers approve of it.
  • Monitor charging to prevent overheating or battery stress
  • Document charging start/end times and charge levels

Charging times may vary based on station availability and vehicle specifications.

Car Wash & Detailing Standards

Service providers will:

  • Use non‑abrasive, EV‑safe cleaning products
  • Avoid high‑pressure water on sensitive EV components
  • Protect charging ports, sensors, and cameras during washing
  • Notify the customer of any pre‑existing damage before service begins

Liability and Damages

Misuse of customer vehicles or damage caused by Providers during service is strictly prohibited. Customers can file an insurance claim for vehicle damage, missing items and accident against the driver. Claim must be filed within 24 hours. All required photos and videos must be clear, complete, and captured from proper angles. Failure to comply may result in rejected documentation or delays.

The customer is responsible for:

  • Pre‑existing mechanical or cosmetic issues
  • Hidden defects that cause operational failure during service

Vehicle Access & Security

Service providers will:

  • Keep keys secure at all times
  • Use GPS‑tracked valet routes
  • Maintain logs of all vehicle movements

Service Completion & Return

Upon completion, Service providers will:

  • Return the vehicle to the agreed location
  • Ensure the vehicle is locked and secured
  • Provide a digital service summary including charge level, wash details, and any noted issues

Assumption of Risk

I understand that, even with reasonable care, automotive services involve inherent risks, including minor scratches, water intrusion, chemical sensitivities, electronic malfunctions, and unexpected reactions to cleaning products. I voluntarily accept these risks.

Release of Liability

To the fullest extent allowed by law, I release and hold harmless CarComfort, its employees, agents, and contractors from claims arising from:

  • vehicle damage not caused by gross negligence or intentional misconduct
  • loss of personal items left in the vehicle
  • delays, service changes, or conditions caused by weather or other unforeseen circumstances

Customer Responsibilities

I agree to:

  • Provide accurate information about the vehicle’s condition
  • Disclose any aftermarket parts, sensitive materials, or prior damage
  • Retrieve the vehicle promptly after service unless other arrangements have been made

Authorization for Vehicle Operation

I authorize CarComfort staff to move, operate, and transport my vehicle as reasonably necessary to complete the service, including pickup, drop-off, and repositioning.

Payment and Satisfaction

I agree that payment is due upon completion unless otherwise stated. Any concerns about service quality must be reported within 24 hours after service is completed.

Media Permission (Optional)

I authorize CarComfort to take photos or videos of my vehicle for documentation or promotional purposes.

Governing Law

(a) This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. (b) Both parties consent to the personal jurisdiction of the state and federal courts located in Philadelphia County, Pennsylvania. (c) If either party hires attorneys to enforce rights under this Agreement, the losing party must reimburse the prevailing party for reasonable attorneys’ fees.

Incorporation of terms

The terms, conditions, and provisions of the CarComfort LLC Terms and Conditions are fully incorporated into this Waiver by this reference as if set forth fully herein. Customers acknowledge that they have read, understood, and agreed to be bound by all such terms. In the event of any conflict between this Waiver and the incorporated document, the terms of this Waiver shall govern.

Amendments to Terms

CarComfort may revise these Terms at any time. The latest version will remain available on our website or app. By continuing to use the Services, you accept the updated Terms.

Acknowledgement

This acknowledgement constitutes the entire understanding between the parties and supersedes all prior discussions. By using our platform, customers agree to our platform liability and waiver agreements. Customers authorize a certified, vetted and trained CarComfort valet service provider to operate their vehicle solely to perform the requested service. CarComfort is not responsible for vehicles with preexisting issues and customers are responsible for ensuring their vehicle is safe to drive and has enough fuel or charge to reach the nearest service location.

By booking or using CarComfort services, the customer confirms that they have read, understood, and voluntarily accepted these terms and this liability waiver. Customers acknowledge that CarComfort is not responsible for pre-existing damage, wear, or defects. Customers will be responsible for any items left in the vehicle and agree they have removed all valuables before service.
